What Safety Certificates Do Landlords Need?
In Scotland, landlords are required to have six safety certificates to rent out a property. If your property is a House in Multiple Occupation (HMO), there are two additional certificates you’ll need. Let’s break down what each certificate involves and why it’s crucial for compliance.
 
1. Smoke & Heat Alarms
By law, all rental properties in Scotland must have interlinked smoke and heat alarms installed. The setup is straightforward:
  • One smoke alarm in the living room or main room.
  • One smoke alarm in every hallway and landing.
  • One heat alarm in the kitchen.
All alarms should be ceiling-mounted and interlinked. If you have a carbon-fuelled appliance, like a gas boiler, a carbon monoxide detector must also be installed in the same room. Compliance with these regulations ensures your tenants are protected against fire hazards. We recommend checking these alarms annually, even though the law only requires checks every 10 years for non-HMO properties.
 
2. EICR – Electrical Installation Condition Report
An EICR is essential to ensure the safety of your property’s electrical system. This report, which must be conducted every five years, involves a qualified electrician inspecting the electrical installations to identify potential hazards and recommend improvements. This is a key measure to prevent electrical fires or shocks, keeping your tenants safe and your property compliant.
 
3. Gas Safety Certificate – CP12 Report
Landlords must have a valid CP12 report, which is issued after a qualified Gas Safe engineer inspects all gas appliances. The check ensures that your boiler and other gas systems are safe for use, with this certificate needing to be renewed annually. Regular checks are not just a legal obligation but offer peace of mind for both you and your tenants.
 
4. LRA – Legionella Risk Assessment
Legionella bacteria can thrive in water systems, leading to Legionnaires’ disease if not properly managed. As a landlord, you are legally required to conduct a Legionella Risk Assessment (LRA). 5. EPC – Energy Performance Certificate
An EPC measures your property’s energy efficiency on a scale from A (most efficient) to G (least efficient). This certificate is required by law and must be included in property advertisements. An EPC is valid for 10 years, but if you’ve made improvements, we recommend renewing it to reflect your property’s new efficiency rating, which could make it more attractive to potential tenants.
 
6. PAT – Portable Appliance Testing
If you provide electrical appliances as part of your rental property, you must ensure they are safe for tenant use. PAT testing is legally required to check the safety of these appliances, with certification lasting five years. We advise annual checks to catch potential faults early and prevent electrical accidents.

7. Emergency Lighting Certificate (BS 5266)
Emergency lighting is essential in HMOs to ensure safe evacuation in case of a fire. You are legally required to have emergency lighting installed and tested annually. This lighting should clearly illuminate fire exits and be properly maintained to avoid fines or safety risks.
 
8. Portable Fire Extinguisher Report
HMOs must be equipped with fire extinguishers, and a qualified engineer must issue a certificate confirming that they are properly installed and maintained. This check ensures your tenants have the means to extinguish small fires quickly and safely.
